Legislative Changes in South Australia: A Focus on Safety and Justice

Headlining a long list of legislative changes introduced into Parliament this week, are tougher penalties for child sex offenders, stiffer penalties on offenders who use minors as props and protection for live music venues in the State.

Federal Government plans to ban minors from using social media were the first taken up from South Australia on the Malinauskas Labour Government legislative agenda.

This week the Government passed legislation through at least one house:

  • To create the toughest penalties in the nation for criminals who recruit children to commit crimes;

  • That will deliver indefinite detention for repeat serious child sex offenders;

  • To save the Cranker;

  • To increase consumer protections for retirement village residents;

  • To deliver major reform to the motor vehicle driver training sector;

  • To strengthen bail laws for terror suspects;

  • To strengthen protections for individuals who suffer identity theft;

  • To extend portable long service leave to workers in the community services sector in South Australia;

  • To ensure small businesses receive government payments on invoices in a timely manner;

  • To strengthen Aboriginal heritage laws;

  • To codify the common law rule of forfeiture;

  • To help the Public Trustee become more efficient;

  • To ensure Aboriginal people can give evidence about their own laws and customs in court;

  • To close a loophole in the spent convictions framework;

  • To update outdated explosives legislation;

  • To close a loophole that allowed repeat motor vehicle offenders to avoid additional penalties;

  • To allow the Government to deliver its budget commitments.

The Government introduced legislation:

  • To give the Small Business Commissioner greater powers to mediate and resolve small business disputes;

  • To create tougher penalties for people who abuse and neglect animals;

  • To ban LGBTQIA+ conversion practices in South Australia;

  • To deliver ongoing monitoring of the greyhound industry in line with the recommendations of an independent inquiry;

  • To protect consumers from incurring costs of being left with unfinished shared infrastructure around residential builds – similar to that which occurred due to the collapse of Felmeri;

  • To protect the community from claim farming;

  • And to keep high risk offenders laws strong.

🪵 The State Government and SAFPA are collaborating in a $250,000 investment in the new career campaign, 'This Is Wood Work', promoting all the different career pathways on offer throughout the forest and timber industries. In an effort to increase variety in job offerings, the multi-faceted campaign encompasses Forest Management, Harvest and Haulage, Saw and Wood Production, and Corporate Services.

🐕 The Malinauskas Government is moving to introduce a Bill amending the Animal Welfare Act and introducing harsher penalties for neglecting animals. If passed, the proposed amendments will increase the maximum penalties to $250,000 or up to 10 years imprisonment for those found mistreating animals. Community consultation showed wide-ranging support from more than 1,000 individuals who provided feedback on the proposed changes.

⛑️ The Malinauskas government has passed the Late Payment of Government Debts Amendment, which will guarantee that government contractors receive payment within 15 days of an invoice being received. The reforms, now through parliament, will support cash flow and enhance financial stability for South Australian businesses fighting against the current economic climate. Timely payments of invoices are of paramount importance, with more than $22 billion in payments made in the past year alone.

🚨 Legislation allows indefinite jailing of repeat serious child sex offenders in South Australia. The toughest laws in the nation will be enacted-ones that will require those offenders to prove that they have control over their sexual instincts before being released. The government will work with South Australia Police.

🚔 For organizing children to commit serious criminal offenses, South Australia has enacted legislation that puts severe punishment on criminals. The most severe punishments within the country apply to any major indictable offense whether the child commits the crime or prosecution. A maximum penalty would be higher if cases where the crime involved attracts a penalty of more than 15 years.

⚽ The Malinauskas State Government is pleased with the announcement of the National Gender Equity in Sports Governance Policy, which builds on previous efforts to advance women in South Australia's sport, focusing on gender equity targets for national and state-level sport bodies.

New Compensation Scheme for SA Households and Small Businesses

A new safeguard that will allow small businesses and households in South Australia to claim compensation of up to $15,000 for property damage caused by electrical infrastructure failures is the latest measure to benefit them directly.

The Details: The proposed Small Claims Compensation Scheme would allow energy consumers who use less than 160 MWh of electricity per year to seek compensation from SA Power Networks where a failure of SAPN's electricity infrastructure leads to a voltage variation that causes property damage. The incident would in substance relate to damage to electrical appliances as well as food spoilage and other related losses.

Significance of the Proposed Scheme: The proposed scheme fills a hole in the insurance market, drawing a distinction between damage from natural disasters on one hand and failure in the electrical infrastructure on the other.

The minimum claim amount is $100, with a maximum of $15,000.

The scheme will be administered by SAPN, including investigation and assessment of claims. Disputes will be referred to the Energy and Water Ombudsman SA. Claims for incidents can be made from 1 July 2022. There is a two-year limit on claimants making a claim, and retrospective claims should be made within two years of the commencement of the scheme. The cost of the scheme is to be recovered by SAPN through regulated distribution charges and "will increase the average annual residential bills by $1.30-$2.30".

Bottomline: Customers will have confidence, knowing there is a recourse for any damages due to distributor negligence, as the process will be overseen by SAPN, and that the Energy and Water Ombudsman SA is there to assist in dispute resolution. Costs of the scheme are to be recovered through regulated distribution charges, and are expected to increase average residential bills by $1.30 to $2.30 annually.

Just a quick 10-minute drive from the heart of Mt. Gambier city, you'll find our lovely restaurant. I thought it was just your average steakhouse, but it's actually a fine dining restaurant!

I heard they have their own unique way of doing things, including growing and aging their own beef! And, of course, they have an amazing wine list to pair with it. The menu has lots of other delicious options, too! I went for the prosciutto-wrapped chicken breast, and my wife had the Barn's prime aged grass-fed porterhouse, which is 400 grams.

The smallest porterhouse was a whopping 400 grams, while the fillet was 250 grams. The portions of meat are really generous! I had a 400g porterhouse with a baked potato and salad, and it was so good! It was cooked rare, and it was absolutely delicious! The wine list is extensive and there isn't much under $70.

I was a little surprised by the markup compared with a cellar door, which was 100%. It was a little high, but not bad. This is a great place for a dinner date, but it might not be the best for small children.

The atmosphere is lovely, and the steak is cooked to perfection. The service is excellent, too. Thank you for the best meal I've had in quite a while! I highly recommend it. My only slight criticism would be that the lights were a bit too dark. - Miko Santos

Lake MacDonnell

Lake McDonnell, a pink salt lake, is 15 km south of Penong on the way to Point Sinclair.
The salty lake appears salmon pink on clear days. One side of the causeway is Pink Lake, the other Green Lake, and Blue Lake over the small bridge. Salt-loving algae dunaliella salina and halobacteria secrete carotenoid red pigments to make Pink Lake pink. Lake MacDonnell's colour depends on water levels.
